1. Who we are and what these terms cover

These terms govern your use of BANKED: the web app at app.banked.fit and the BANKED iOS app (together “the service”), as well as this website (banked.fit). By creating an account or using the service you agree to them. If you do not agree, please do not use the service.

BANKED is currently free of charge. There is nothing to buy. If a paid tier (“Banked Plus”) is introduced, its price, billing terms and your cancellation rights will be shown to you clearly before any purchase, and these terms will be updated first. Candidate prices shown on this website are not an offer.

2. Eligibility and account

You must be at least 18 years old to use BANKED. You sign in with your email address and a one-time code; there is no password. Keep access to your email account secure — anyone who can read your email can sign in as you. One account per person. Give us a working email address; it is the only way we can reach you.

You can stop using the service at any time and ask us to delete your account and data (see the app privacy policy).

3. What the service does — and what it is not

BANKED turns a goal you choose into a weekly training plan, suggests strength sessions based on the equipment and time you have, calculates calorie and protein targets from the body data you enter, and lets you log weight, meals and activities. Suggestions follow fixed, transparent rules; AI is used only to recognise foods in a photo or text description, never to decide your programme.

BANKED is not medical advice, diagnosis or treatment. It does not know your medical history. Before starting or changing an exercise or nutrition programme, consult a doctor — especially if you are pregnant, have a medical condition, an injury, an eating disorder history, or take medication. Stop exercising if you feel pain, dizziness or shortness of breath. You are responsible for choosing weights and movements you can perform safely and for your training environment.

Calorie, protein and energy-expenditure figures are estimates and are shown as approximate (“≈”). Food recognition can be wrong; always check and correct what the app suggests.

4. Acceptable use

You agree not to:

• use the service for anything unlawful, or enter unlawful, abusive or other people’s personal content in free-text fields, forms or photos;
• access the service by automated means, probe or overload it, or try to reach other users’ data;
• copy, resell or redistribute the exercise library, texts, images or design, or remove any notices;
• reverse-engineer the service except where the law expressly allows it.

5. Your data and content

Everything you enter stays yours. You grant us the right to store and process it only as needed to provide the service to you, as described in the website privacy policy and the app privacy policy. Your data is never shared with other users or sold.

6. Our rights

The service and this website, including software, exercise library, texts, images, design and the BANKED name, are protected by copyright and other rights and belong to us or our licensors. You receive a personal, non-transferable, non-exclusive right to use the service for your own non-commercial fitness. Open-source components remain under their own licences.

7. Availability and changes to the service

We provide the service as it is, free of charge, and aim to keep it available but do not guarantee uninterrupted availability. We may change, add or remove features, run maintenance, or discontinue the service. Where reasonably possible we will announce material changes or a shutdown in the app in advance so you can export or note down your data.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have assumed a guarantee. For slight negligence we are liable only for breach of essential contractual obligations (obligations whose fulfilment makes proper performance possible and on which you may regularly rely), limited to the damage typical for this kind of service and foreseeable at the time. You are responsible for damage resulting from exercising or eating in a way that ignores the guidance in section 3.

9. Termination

You may stop using the service at any time and request deletion of your account. We may suspend or end your access if you materially breach these terms, where possible after warning you first, and we may end the service as a whole under section 7. Sections 5, 6 and 8 continue to apply after termination as far as their content requires.

10. Changes to these terms

We may update these terms when the service or the law changes. We will show you the changed terms in the app and, for material changes, ask you to accept them before you continue. The current version, with its date, is always available here. [TO VERIFY: change mechanism under German consumer law]

11. Governing law and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another EU or EEA country, the mandatory consumer-protection rules of your country of residence remain unaffected. The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

If any provision of these terms is invalid, the remaining provisions remain in force.
